ENTIRE AGREEMENT
This is the entire agreement between you ("You") and Pathway Intelligence Incorporated ("PI"). The effective date of this Agreement is when You accept this Agreement in accordance with the procedure set out above.
OBJECTIVE OF WEBSITE
PI's goal is to encourage less vehicle traffic on the roads of Canada in the interest of reduced commuting costs, improved community health, and clean air. However, www.carpooltool.com (the "Website") is not providing a public transportation service.
DAILY COMMUTERS CARPOOL
You acknowledge that the Website is a carpool matching service designed to assist daily commuters to find appropriate partners to share the ride to their workplace. You acknowledge that the Website is not designed to match riders with drivers for one-time or occasional trips and that PI reserves the right to revoke Your membership and remove You from the system if it is determined that You are using the Website for such a purpose.
DISCLAIMER
You acknowledge that PI does not conduct any background checks on the users of the Website. You acknowledge that it is Your responsibility to contact, interview and select the carpool partners who are most appropriate for Your needs.
APPLICABLE LAWS
You acknowledge that specific federal and provincial statutes such as: Highway Traffic Act, R.S.O. 1990, c. H.8 as amended, Communter Services Act, R.S.O. 1990, c. C.23 as amended, Public Vehicles Act, R.S.O. 1990, c. P.54 as amended and Insurance Act, R.S.O. 1990, c. I.8 as amended contain legal obligations concerning carpooling. You acknowledge that it is Your responsibility to become familiar with the legalities of participating in a carpool. Specifically, You acknowledge that it is Your responsibility to contact Your vehicle insurer and verify that You have sufficient insurance coverage to protect Yourself and Your carpool passengers.
FREE OF CHARGE
PI is providing basic carpool matching service free of charge. Any agreement made between You and fellow carpoolers regarding cost sharing does not involve PI.
PERSONAL INFORMATION
You consent to PI's collection, use and disclosure of Your email address and full name. Your full name and email address will not be disclosed to the general membership. YOU MAY ACCESS, CORRECT AND DELETE YOUR OWN PERSONAL INFORMATION STORED BY PI BY USING THE WEBSITE OR BY EMAILING THE ADMINSTRATOR THROUGH THE "CONTACT US" PAGE.
WAIVER AND INDEMNITY
In consideration of You becoming a member with the Website, You agree to waive any and all claims You may have against PI and DMTI Spatial Inc. for any claim, demand, misadventure or damage suffered as a result directly or indirectly from membership with the Website or in any activities associated with it. Further, You agree to indemnify and hold PI and DMTI Spatial Inc. harmless from any claim, demand, misadventure or damage asserted by any third party due to or arising out of Your use of the Website. You acknowledge that if You are dissatisfied with the carpool matching service or the materials available on the Website, Your sole and exclusive remedy is to discontinue using the Website.
MODIFICATION
PI reserves the right to modify this Agreement at anytime, without prior notice and such modification shall be effective immediately upon posting on the Website. It is Your responsibility to review this Agreement periodically and make Yourself aware of any modifications. Your continued use of this Site will be deemed to be Your conclusive acceptance of the modified Agreement.
READ AND UNDERSTAND THE ENTIRE AGREEMENT
By viewing, using or posting materials on the Website, or by participating in any programs offered by PI You hereby acknowledge that You have read, are familiar with, and agree to the terms and conditions of the Website in their entirety.
